The SGO Advantage
A qualified Scholarship Granting Organization receives eligible cash contributions and awards scholarships for qualified K–12 educational expenses. Donors—not scholarship recipients—may claim the federal credit, subject to Section 25F and IRS requirements.
October 2026 Regulatory Update
Treasury and IRS published temporary regulations T.D. 10057 and proposed regulations REG-117199-25 on October 2, 2026. The temporary regulations are effective December 1, 2026 and apply on or after September 1, 2026. The comprehensive operational rules are proposed and may change.

Maintain one or more segregated Section 25F accounts with separate books and records for all qualified contributions.

Student Distribution
Provide scholarships for at least 10 students annually who are not all enrolled at the same school.

Qualified Expenses
Funds must be used exclusively for qualified K–12 educational expenses as defined by federal and state regulations.

Granting Priority
Priority given to renewals and siblings; donor earmarking for specific students is strictly prohibited.
Key 2027 Deadlines
- SGO IRS portal registration before January 1, 2027
- Advance-election State SGO lists for 2027 due February 15, 2027
- Donor acknowledgments by January 31 after the contribution year, including SGO EIN, aggregate qualified contributions, unique donor number, and goods/services statement
- IRS portal donor reporting by February 28
85% vs. 90%
85% is the scholarship-granting activity threshold; 90% is the scholarship spending test. Under the proposed safe harbor, a qualifying single-State SGO may apply operational rules and the 90% test at its segregated account; otherwise the proposed rule generally measures total gross receipts organization-wide.

Common Questions
What is an SGO?
An SGO is a specialized nonprofit entity designed to manage scholarship grants and qualify for the $1,700 federal education tax credit under IRC Section 25F, starting in 2027.
Is a 501(c)(3) enough?
No. While a 501(c)(3) is a foundation, it is not automatically SGO-ready. Specific bylaws, policies, and operational structures are required to meet federal eligibility criteria.
How do I start the process?
We provide a step-by-step roadmap to guide you through state registration, EIN acquisition, and the implementation of SGO-specific governance and compliance protocols.
What are the compliance costs?
Compliance is an ongoing responsibility. We assist with Form 990 filings and ensure adherence to state-specific registration and designation requirements.
